The Supreme Court’s Appellate Division published a 29-page judgment on 25 October in the long-running dispute over the seniority and service benefits of teachers from nationalised primary schools.
The judgment allows the state’s appeal against a High Court decision. The four-member appellate bench delivered its ruling on 2 July; publication of the full written reasons is the new development.
Attorney General Md Ruhul Quddus Kazal had said the ruling removed legal complications affecting recruitment to around 32,000 primary school headteacher posts.
The case arose from a 2017 petition seeking recognition of part of teachers’ earlier service for seniority and other benefits. In 2019, the High Court declared part of the relevant 2013 service rules unlawful. The state subsequently appealed.
Publication of the judgment is not itself an announcement that those headteachers have been appointed.
